1. Introduction
This document is an electronic record in accordance with the Information Technology Act, 2000 and the rules made thereunder, including applicable amendments relating to electronic records. This electronic record is generated by a computer system and does not require any physical or digital signature.
These Terms & Conditions govern access to and use of the SafarTrak website, web application, mobile application, dashboards, software, APIs, GPS tracking systems, fleet management tools, telematics solutions, support services, hardware services, installation services, and related services collectively referred to as thePlatform.
The Platform is owned and operated by ZEVON SYSTEMS LLP, a limited liability partnership incorporated under applicable laws of India, having its registered office at [Registered Office Address], hereinafter referred to as "ZEVON SYSTEMS LLP", "SafarTrak", "Company", "we", "us", or "our".
By accessing, browsing, registering, subscribing to, integrating with, purchasing, installing, or otherwise using SafarTrak, you agree to be legally bound by these Terms & Conditions, together with any applicable order form, quotation, invoice, proposal, service agreement, statement of work, service level agreement, privacy policy, data processing agreement, support policy, hardware policy, or other policy referenced herein.
If you do not agree with these Terms, you must not access, use, subscribe to, or purchase any SafarTrak services.
2. Definitions
For the purpose of these Terms:
Customer means any individual, business, organisation, school, logistics company, transporter, fleet operator, corporate entity, partnership firm, limited liability partnership, company, or legal person subscribing to or using SafarTrak.
User means any person authorised by the Customer to access the Platform.
Driver means any person operating a vehicle, asset, or fleet unit monitored through SafarTrak.
Data Principal means an individual to whom personal data relates, as understood under applicable Indian data protection law.
Customer Data means data uploaded, submitted, transmitted, generated, collected, stored, or processed by or on behalf of the Customer through the Platform.
Fleet Data means vehicle, driver, route, trip, geofence, alert, location, speed, device, fuel, attendance, asset, and telematics-related data.
Personal Data means any data about an individual who is identifiable by or in relation to such data.
Services means the software, dashboards, mobile apps, APIs, support, integrations, hardware-related services, installation services, reporting tools, and related offerings provided by SafarTrak.
Subscription Plan means the commercial plan selected by the Customer.
Hardware means GPS devices, sensors, accessories, wiring, SIM-enabled devices, or any other equipment supplied by or through SafarTrak.
Order Form means any written or electronic document, quotation, proposal, invoice, purchase order, or agreement specifying the services, devices, pricing, term, and commercial scope.
3. About SafarTrak
SafarTrak is a GPS tracking, fleet management, vehicle monitoring, telematics, route optimisation, geofencing, operational visibility, workforce tracking, asset monitoring, and fleet intelligence platform.
Depending on the subscribed plan, SafarTrak may provide features including but not limited to:
- Real-time vehicle tracking
- Fleet dashboard and reports
- GPS history and trip replay
- Route monitoring and optimisation
- Geofence creation and alerts
- Driver behaviour insights
- Vehicle utilisation reports
- Field workforce visibility
- Attendance and movement logs
- Asset tracking
- Mobile application access
- API integrations
- Notifications through SMS, email, WhatsApp, push notifications, or other channels
- Device and hardware management
- Installation, removal, reinstallation, or device swapping support
- Reports, analytics, alerts, and operational dashboards
Feature availability may vary based on subscription plan, device type, hardware compatibility, integration scope, region, vehicle condition, network availability, third-party service dependency, and the applicable commercial agreement.
4. Eligibility
By using the Platform, you represent and warrant that:
- You are at least 18 years of age.
- You have full legal capacity to enter into a binding agreement.
- If you are acting on behalf of an organisation, you are authorised to bind that organisation.
- You will use SafarTrak only for lawful business, operational, fleet, logistics, safety, monitoring, compliance, asset management, or transport-related purposes.
- You will not use the Platform for unlawful surveillance, harassment, unauthorised tracking, or any activity prohibited by applicable law.
5. Account Registration and Administration
Customers may be required to create an account to access the Platform.
The Customer is responsible for:
- Providing accurate and complete registration information.
- Maintaining confidentiality of usernames, passwords, OTPs, API keys, access tokens, and administrator credentials.
- Managing user roles and access permissions.
- Ensuring that only authorised personnel access the Platform.
- Immediately notifying SafarTrak of any suspected unauthorised access.
- Removing access for employees, contractors, or users who no longer require Platform access.
- Ensuring that all activities performed through the Customer account are authorised and lawful.
SafarTrak shall not be liable for any loss arising from unauthorised use of Customer credentials, unless such loss is directly caused by SafarTrak's proven negligence or wilful misconduct.
6. Subscription, Fees and Payment Terms
Use of certain Services may require a paid subscription. The Customer agrees to pay all applicable fees as specified in the relevant proposal, quotation, invoice, subscription plan, order form, purchase order, or written agreement.
Unless otherwise agreed in writing:
- Subscription fees are payable in advance.
- Taxes, including GST where applicable, shall be charged separately.
- Delayed payments may attract suspension, restriction, or termination of services.
- SafarTrak may charge reactivation, device replacement, installation, removal, reinstallation, swapping, support, integration, configuration, training, or customisation fees where applicable.
- Pricing may be revised with reasonable notice before renewal or future billing cycles.
- Any out-of-pocket expenses, travel costs, courier charges, technician visit charges, logistics costs, or third-party costs may be charged to the Customer where applicable.
SafarTrak may suspend or restrict access if payment remains overdue after written notice.
7. Refund & Cancellation
7.1 Refund Eligibility
SafarTrak follows a limited refund policy.
Refunds may be considered only in the following circumstances:
- Duplicate payment made by the Customer.
- Verified billing or invoicing error attributable to SafarTrak.
- Payment received but Services were not activated.
- Hardware ordered but not delivered due solely to reasons attributable to SafarTrak.
- Any other circumstance expressly approved in writing by SafarTrak.
Approved refunds shall be processed through the original payment method or another mutually agreed payment mechanism.
7.2 Non-Refundable Items
Unless otherwise agreed in writing, the following shall be non-refundable:
- Activated subscription plans.
- Partially used subscription periods.
- Installation charges.
- GPS device installation or reinstallation charges.
- Device swapping charges.
- SIM, telecom, SMS, WhatsApp, email, or third-party communication costs.
- Custom development charges.
- API integration charges.
- Training and onboarding fees.
- Support service fees.
- Travel, logistics, courier, technician visit, or field support expenses.
- Hardware already installed or successfully delivered.
- Services suspended due to Customer breach of these Terms.
- Services discontinued due to misuse, unauthorised tracking, unlawful activity, or payment default.
7.3 Subscription Cancellation
Customers may cancel renewal of subscription services by providing written notice before the next billing cycle or subscription renewal date.
Cancellation shall not:
- Automatically entitle the Customer to a refund.
- Waive outstanding invoices or dues.
- Affect payment obligations already incurred.
- Release the Customer from paying for services already activated, delivered, installed, configured, or used.
Access to services shall continue until expiry of the paid subscription period unless otherwise agreed in writing.
7.4 Hardware Cancellation
Orders for GPS devices, sensors, accessories, SIM-enabled devices, or hardware may not be cancelled after:
- Device dispatch.
- Installation scheduling.
- Device activation.
- Installation completion.
- Hardware allocation to the Customer.
- Custom configuration or provisioning of the device.
Hardware returns, replacements, and warranty claims shall be governed by the Hardware Warranty section of these Terms or any separate Hardware Warranty Policy issued by SafarTrak.
7.5 Refund Processing Timeline
Where a refund has been approved:
- SafarTrak shall initiate processing within a commercially reasonable period.
- Final credit timelines may depend on payment gateways, banks, card issuers, financial institutions, or payment service providers.
- Applicable taxes, payment gateway charges, logistics expenses, installation costs, technician costs, hardware handling charges, or third-party charges may be deducted where legally permissible.
- Refunds shall not be treated as approved unless confirmed in writing by SafarTrak.
8. Enterprise Orders, SOWs and Separate Agreements
For enterprise customers, the commercial relationship may additionally be governed by a separate Master Service Agreement, Statement of Work, Enterprise Order Form, Service Level Agreement, Data Processing Agreement, Non-Disclosure Agreement, Hardware Installation Agreement, Support Agreement, or other written contract.
In case of conflict, the following order of precedence shall apply unless otherwise agreed in writing:
- Signed Master Service Agreement or Enterprise Agreement
- Signed Statement of Work or Order Form
- Data Processing Agreement
- Service Level Agreement
- Support or Hardware Policy
- These Terms & Conditions
- Website policies and online notices
9. Licence to Use the Platform
Subject to payment of applicable fees and compliance with these Terms, SafarTrak grants the Customer a limited, non-exclusive, non-transferable, revocable, non-sublicensable licence to access and use the Platform solely for the Customer's internal business operations.
The Customer shall not:
- Sell, resell, licence, sublicense, rent, lease, distribute, or commercially exploit the Platform.
- Reverse engineer, decompile, disassemble, copy, or attempt to derive the source code of the Platform.
- Build a competing product using SafarTrak's features, workflows, data structures, dashboards, reports, or user interface.
- Remove proprietary notices, trademarks, copyright notices, or branding.
- Use the Platform beyond subscribed limits.
- Share access with unauthorised third parties.
- Use SafarTrak for unlawful monitoring, stalking, harassment, illegal surveillance, or unauthorised tracking.
10. Customer Responsibilities
The Customer is solely responsible for:
- Lawful deployment and use of tracking devices.
- Obtaining driver, employee, contractor, parent, guardian, vehicle owner, or vehicle user consent where required.
- Ensuring compliance with labour laws, privacy laws, transport rules, employment policies, school transport rules, contractual obligations, and internal HR policies.
- Accuracy of vehicle, driver, asset, geofence, organisation, billing, and operational data entered into the Platform.
- Internal communication to monitored individuals.
- Maintaining adequate vehicle power supply and hardware protection.
- Ensuring lawful use of location, driver, fleet, and telematics data.
- Raising support tickets or reporting device issues promptly.
- Avoiding misuse, unauthorised disclosure, or unlawful sharing of reports and tracking data.
SafarTrak provides technology infrastructure and does not control how Customers use tracking data in their internal operations.
11. GPS Accuracy, Connectivity and Hardware Dependencies
SafarTrak's performance depends on third-party and external factors including GPS satellites, telecom networks, SIM providers, mobile data availability, cloud hosting providers, internet service providers, map providers, device placement, vehicle battery condition, weather conditions, urban density, tunnels, basements, rural network coverage, vehicle wiring, hardware condition, and Customer configuration.
Accordingly, SafarTrak does not guarantee:
- 100% GPS accuracy at all times.
- Continuous uninterrupted tracking.
- Real-time updates in every location.
- Guaranteed prevention of theft, misuse, accident, route deviation, delay, or operational failure.
- Error-free third-party map, traffic, address, or location data.
- Accurate tracking where device signal, power, SIM connectivity, or vehicle wiring is affected.
SafarTrak shall make commercially reasonable efforts to provide reliable services, subject to reasonable technical limitations.
12. Installation, Reinstallation, Removal and Device Swapping
Where hardware installation, reinstallation, removal, or device swapping is required, the Customer must provide access to the vehicle, location, authorised representative, and necessary vehicle details.
Device swapping means removing a device from one vehicle and installing it in another vehicle. Such services may be subject to additional charges depending on location, technician availability, travel, wiring condition, device type, and commercial agreement.
The Customer must raise installation, removal, repair, or swapping requests through SafarTrak's approved support channels. Turnaround time may vary depending on location, technician availability, vehicle availability, issue severity, and operational feasibility.
SafarTrak shall not be responsible for delay caused by Customer's failure to provide vehicle access, correct location, working vehicle condition, authorised representative, or required information.
13. Hardware Warranty
Hardware supplied by or through SafarTrak shall carry a standard limited warranty of twelve (12) months from the date of installation, unless otherwise specified in writing in the invoice, order form, proposal, or agreement.
Warranty may cover manufacturing defects and internal device failure under normal usage conditions.
Warranty shall not cover:
- Physical damage
- Water ingress
- Fire damage
- Electrical surge
- Vehicle battery issues
- Accident-related damage
- Device tampering
- Unauthorised opening or repair
- Improper installation by third parties
- Loose wiring caused by third parties
- SIM or telecom issues
- Theft or loss of device
- Damage caused by Customer, driver, employee, contractor, mechanic, or any unauthorised person
- Use outside prescribed conditions
Defective hardware must be inspected and verified by SafarTrak or its authorised representative before replacement approval.
Out-of-warranty repair, replacement, removal, visit, or reinstallation may be chargeable.
14. Support and Issue Reporting
Customers must report issues through approved communication channels such as email, ticketing system, support number, WhatsApp support, or any support portal provided by SafarTrak.
Support requests should include relevant details such as:
- Customer name
- Registered phone or email
- Vehicle number
- Device ID, if available
- Issue description
- Screenshot, video, or report reference, if applicable
- Location of vehicle, if technician visit is required
SafarTrak shall make commercially reasonable efforts to investigate and resolve reported issues. Response and resolution times may vary based on issue type, severity, device status, network dependency, third-party dependency, vehicle availability, and location.
15. Customer Data Ownership
The Customer retains all rights, title, and ownership in Customer Data and Fleet Data.
SafarTrak does not claim ownership over Customer Data.
SafarTrak is authorised to access, host, process, transmit, analyse, and store Customer Data only for the following purposes:
- Providing the Services.
- Generating reports and dashboards.
- Troubleshooting issues.
- Supporting customer requests.
- Improving platform reliability, security, and performance.
- Enabling integrations and notifications.
- Complying with applicable law.
- Preventing fraud, misuse, or unauthorised access.
SafarTrak may use aggregated, anonymised, or de-identified data for analytics, benchmarking, system improvement, and product development, provided such data does not identify the Customer, individual users, drivers, vehicles, or business-sensitive operations.
16. Data Export and Portability
Upon expiry or termination of services, the Customer may request export of available Customer Data within the data retention period specified in SafarTrak's Data Retention Policy or the applicable agreement.
Data may be provided in commercially reasonable formats such as CSV, Excel, PDF reports, API export, dashboard export, or other available formats depending on data type, subscribed plan, and technical feasibility.
SafarTrak may delete, anonymise, or archive Customer Data after termination in accordance with its data retention practices, legal obligations, backup cycles, and contractual requirements.
Customers are responsible for downloading required reports before cancellation, termination, plan expiry, or account closure.
17. Data Retention
Customer Data shall be retained only for as long as required for operational, contractual, compliance, billing, support, audit, security, and legal purposes.
Unless otherwise agreed in writing:
- System, application, diagnostic, and security logs may be retained for up to one hundred and eighty (180) days, unless a longer retention period is required by law, contractual obligations, regulatory requirements, security investigations, or dispute resolution.
- Billing, taxation, invoice, accounting, and financial records may be retained for the period required under applicable law.
- Trip history, GPS logs, reports, device logs, and alert history may be retained based on the Customer's subscription plan, storage limits, and commercial agreement.
- Deleted data may remain in backups for a limited period until backup rotation, archival deletion, or disaster recovery cycles are completed.
Upon lawful deletion requests, consent withdrawal, account termination, or expiry of retention requirements, SafarTrak may delete or anonymise Customer Data, subject to legal obligations and backup retention schedules.
18. Security and Compliance
SafarTrak shall implement commercially reasonable administrative, technical, and organisational safeguards designed to protect the Platform and Customer Data.
Such safeguards may include, where applicable:
- Role-based access controls
- Secure authentication mechanisms
- Encryption in transit
- Controlled administrative access
- Logging and monitoring
- Backup procedures
- Incident response workflows
- Segregation of customer accounts
- Vulnerability review and patching processes
- Restricted internal access
- Security review of critical systems
Customer acknowledges that no internet-based service, cloud platform, GPS device, mobile network, telecom service, or network-connected system can be guaranteed to be completely secure.
Customers are responsible for protecting their own credentials, managing user access, removing inactive users, securing internal systems, and promptly reporting suspicious activity.
19. Data Breach Notification
In the event of a confirmed security incident, unauthorised access, or data breach affecting Customer Data, SafarTrak shall use commercially reasonable efforts to notify affected Customers within a reasonable period after becoming aware of such incident, where notification is legally required or operationally appropriate.
Such notification may include, where available and legally permissible:
- Nature of the incident
- Categories of data affected
- Potential impact
- Mitigation measures taken
- Recommended customer actions
- Contact point for further communication
SafarTrak may also notify relevant authorities where required under applicable law.
20. Privacy and Data Protection
SafarTrak's collection, storage, and processing of personal information shall be governed by the SafarTrak Privacy Policy and applicable Indian data protection law, including applicable provisions of the Digital Personal Data Protection Act, 2023, Information Technology Act, 2000, and rules made thereunder.
Where SafarTrak processes personal data on behalf of an enterprise Customer, SafarTrak may act as a data processor or service provider, while the Customer may act as the data fiduciary, controller, employer, fleet operator, school, transporter, or relevant decision-maker responsible for determining the purpose and legality of processing.
The Customer is responsible for ensuring that all required notices, consents, authorisations, employment disclosures, parent or guardian permissions, and lawful bases are obtained before using SafarTrak for tracking or monitoring.
21. Rights of Individuals
Subject to applicable law, individuals whose Personal Data is processed through SafarTrak may request:
- Access to their personal information
- Correction of inaccurate information
- Completion or updating of incomplete information
- Deletion or erasure where legally permissible
- Withdrawal of consent where processing is based on consent
- Information regarding processing activities
- Grievance redressal through the designated grievance channel
- Nomination rights where applicable under law
Where SafarTrak processes information solely on behalf of a Customer, such requests may be redirected to the relevant Customer for verification and action.
SafarTrak may require reasonable identity verification before processing any request.
22. Consent for GPS Tracking
The Customer is responsible for obtaining all required consents, notices, and approvals from monitored individuals, which may include drivers, employees, contractors, vehicle owners, field staff, students, parents, guardians, asset custodians, or other vehicle users.
Customers should clearly disclose:
- That GPS tracking is being used.
- Purpose of tracking.
- Type of data collected.
- Who may access the data.
- How the data may be used.
- Retention period, if applicable.
- Internal contact point for queries.
- Any employee, driver, or operational consequences of tracking.
SafarTrak shall not be responsible for claims arising from Customer's failure to obtain legally required consent or from unlawful use of tracking technology.
21. Third-Party Services and Integrations
SafarTrak may integrate with or depend upon third-party services including but not limited to:
- Map providers
- Telecom operators
- SIM providers
- Cloud infrastructure providers
- SMS, email, WhatsApp, and push notification providers
- Payment gateways
- IoT hardware suppliers
- ERP, HRMS, CRM, TMS, or API integration partners
- Analytics or support platforms
SafarTrak shall not be responsible for failures, delays, inaccuracies, pricing changes, downtime, service limitations, or data issues caused by third-party providers.
Use of third-party services may be subject to their respective terms and privacy policies.
22. Intellectual Property Rights
All rights, title, and interest in the SafarTrak Platform, including software, source code, object code, architecture, interface, workflows, dashboards, trademarks, product names, design elements, documentation, algorithms, reports, templates, scripts, APIs, and know-how, remain the exclusive property of ZEVON SYSTEMS LLP or its licensors.
Customer shall not acquire any ownership rights in SafarTrak except the limited right to use the Platform in accordance with these Terms.
No content, software, interface, workflow, report format, or design may be copied, modified, reproduced, distributed, reverse engineered, or commercially exploited without prior written consent from SafarTrak.
23. Custom Development and Feedback
If SafarTrak develops custom features, integrations, reports, dashboards, APIs, workflows, or enhancements for a Customer, ownership shall be determined by the applicable Statement of Work or written agreement.
Unless expressly agreed otherwise in writing:
- SafarTrak retains ownership of platform-level improvements, reusable modules, generic features, technical know-how, product enhancements, workflows, and software components.
- Customer retains ownership of Customer Data and customer-specific confidential information.
- Suggestions, ideas, feedback, feature requests, or improvement recommendations may be used by SafarTrak to improve the Platform without obligation, provided customer confidential information is not disclosed.
24. Acceptable Use
The Customer and Users shall not use the Platform to:
- Conduct unlawful surveillance.
- Track individuals without legal authority or required consent.
- Harass, discriminate against, threaten, or unlawfully monitor any person.
- Violate employment, labour, privacy, transport, school, or data protection laws.
- Interfere with the Platform's security or operation.
- Attempt unauthorised access to other customer accounts.
- Upload malware, viruses, harmful code, or malicious files.
- Abuse APIs, automation, scraping, crawling, or load testing without written approval.
- Misrepresent tracking data or use reports for unlawful purposes.
- Share login credentials with unauthorised persons.
- Use SafarTrak to build, train, or support a competing product.
- Use tracking data for personal stalking, intimidation, or unlawful disciplinary action.
SafarTrak may suspend access immediately where misuse creates legal, operational, security, or reputational risk.
25. Confidentiality
Each party shall protect confidential information received from the other party using reasonable care and shall not disclose such information except as required for performance of services, legal compliance, or as otherwise authorised in writing.
Confidential information may include:
- Business plans
- Pricing
- Software architecture
- Technical information
- Customer lists
- Fleet operations
- Route data
- Employee information
- Reports
- Login credentials
- Device details
- Commercial terms
- Operational data
- Integration details
This confidentiality obligation shall survive termination of the services.
26. Non-Solicitation
Unless otherwise agreed in writing, during the term of the commercial relationship and for a period of twelve (12) months thereafter, the Customer shall not directly solicit for employment any employee, technician, consultant, or dedicated support resource of SafarTrak who was materially involved in providing services to the Customer.
This clause shall not restrict general recruitment campaigns not specifically targeted at SafarTrak personnel.
27. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis, except as expressly stated in a signed agreement.
SafarTrak disclaims all implied warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted service, absolute GPS accuracy, or error-free operation.
SafarTrak does not guarantee that use of the Platform will prevent theft, accidents, unauthorised vehicle use, route deviations, operational losses, employee misconduct, school transport delays, logistics failures, compliance breaches, or business disruption.
28. Limitation of Liability
To the maximum extent permitted by law, ZEVON SYSTEMS LLP, its partners, employees, contractors, service providers, technicians, vendors, and affiliates shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, including loss of profit, revenue, goodwill, business opportunity, data, contracts, operational continuity, vehicle loss, customer claims, or driver-related claims.
Unless otherwise agreed in a signed enterprise agreement, SafarTrak's total aggregate liability arising out of or related to the Services shall not exceed the fees actually paid by the Customer to SafarTrak for the affected Services during the three (3) months immediately preceding the event giving rise to the claim.
Nothing in these Terms shall exclude liability that cannot be excluded under applicable law.
29. Indemnification
The Customer agrees to indemnify, defend, and hold harmless ZEVON SYSTEMS LLP, its partners, officers, employees, contractors, agents, affiliates, technicians, vendors, and service providers from and against any claims, damages, penalties, losses, liabilities, costs, and expenses arising out of or relating to:
- Customer's breach of these Terms.
- Unlawful or unauthorised tracking.
- Failure to obtain required consents.
- Misuse of GPS, driver, employee, student, asset, or vehicle data.
- Violation of applicable laws.
- Claims by drivers, employees, contractors, vehicle owners, guardians, customers, students, parents, or third parties arising from Customer's use of the Platform.
- Infringement or misuse of third-party rights by the Customer.
- Unauthorised disclosure of reports, credentials, tracking links, or operational data.
- Customer's internal employment, disciplinary, transport, logistics, or operational decisions.
30. Suspension and Termination
SafarTrak may suspend or terminate access if:
- Fees remain unpaid.
- Customer breaches these Terms.
- Use of the Platform creates security, legal, operational, reputational, or compliance risk.
- The Platform is used for unlawful surveillance or unauthorised tracking.
- Customer becomes insolvent or ceases business operations.
- Required third-party services are unavailable, restricted, suspended, or terminated.
- Customer misuses devices, SIMs, APIs, dashboards, or data exports.
- Customer fails to cooperate in investigation of misuse, breach, payment default, or security incident.
Upon termination:
- Customer's access may be disabled.
- Outstanding fees become immediately payable.
- Customer may request data export within the applicable retention period.
- SafarTrak may delete, anonymise, or archive Customer Data in accordance with its policies.
- Customer must return rented, leased, or SafarTrak-owned hardware where applicable.
- Lost, damaged, or unreturned devices may be chargeable.
31. Force Majeure
SafarTrak shall not be liable for any delay or failure caused by events beyond reasonable control, including natural disasters, floods, fire, earthquakes, war, terrorism, riots, government restrictions, court orders, labour disputes, epidemics, pandemics, lockdowns, telecom failures, internet outages, cyberattacks, cloud failures, GPS satellite issues, power failures, map provider issues, SIM provider issues, vehicle-level issues, or third-party service disruptions.
32. Changes to Terms
SafarTrak may modify these Terms from time to time. Updated Terms shall be published on the Website or Platform.
Continued use of SafarTrak after publication constitutes acceptance of updated Terms.
For enterprise customers with signed agreements, material changes may be governed by the change control process stated in the applicable contract.
33. Dispute Resolution, Mediation and Arbitration
The Parties shall first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms through good-faith discussions.
If the dispute remains unresolved within thirty (30) days from the date one Party notifies the other Party of the dispute, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.
The arbitration shall be conducted by a sole arbitrator mutually appointed by the Parties. If the Parties are unable to mutually appoint an arbitrator, the arbitrator shall be appointed in accordance with applicable law.
The seat and venue of arbitration shall be Gurugram, Haryana, India.
The language of arbitration shall be English.
The arbitral award shall be final and binding on the Parties.
Subject to the arbitration clause, courts located in Gurugram, Haryana, India shall have exclusive jurisdiction.
34. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
Subject to the dispute resolution and arbitration provisions above, all disputes shall be subject to the exclusive jurisdiction of the competent courts located in Gurugram, Haryana, India.

All grievances shall be acknowledged within three (3) business days, and reasonable efforts shall be made to resolve the grievance within thirty (30) days from the date of receipt.
If a grievance relates to Customer-controlled data, SafarTrak may redirect the request to the relevant Customer for verification and action.
